Encinitas Dental Art is committed to protecting your privacy and ensuring the security of your
personal and health information.

THIS NOTICE DESCRIBES HOW WE COLLECT, USE, DISCLOSE, AND PROTECT YOUR
INFORMATION IN ACCORDANCE WITH THE HEALTH INSURANCE PORTABILITY AND
ACCOUNTABILITY ACT (HIPAA) AND OTHER APPLICABLE LAWS. PLEASE REVIEW IT
CAREFULLY.

Your Rights

As a patient, you have rights regarding medical information that we maintain about you:

1. Right to Inspect and Copy

You have the right to inspect and obtain a copy of your health information used to make decisions about your benefits. We may charge a fee for copying, mailing, or other supplies.

We may deny your request in certain limited circumstances. If denied, you may request a review. If we do not maintain the information but know who does, we will inform you where to direct your request.

2. Right to Amend Your Records

If you believe that your health information is incorrect or incomplete, you may request an amendment. Your request must be in writing and include a reason.

We may deny your request if:

  • It is not in writing or lacks a valid reason

  • The information:

    • Was not created by us (unless the creator is unavailable)

    • Is not kept by or for the plan

    • Is not subject to inspection

    • Is accurate and complete

3. Right to Request Confidential Communications

You can request that we contact you in a specific way or location (e.g., at work or by mail). We will accommodate all reasonable requests. Your request must specify how and where to contact you.

4. Right to Request Restrictions on Use or Disclosure

You may request limits on how we use or disclose your information for treatment, payment, or operations, or to someone involved in your care. While we are not required to agree, if we do, the restriction may be terminated under certain conditions.

To request a restriction, submit your request in writing and include:

  • What information to limit

  • Whether to limit use, disclosure, or both

  • To whom the limits apply

We must comply with your request if:

  • The disclosure is not legally required

  • The information pertains solely to a paid-in-full service

5. Right to an Accounting of Disclosures

You may request a list of certain disclosures we’ve made of your health information. This excludes disclosures:

  • For treatment, payment, or healthcare operations

  • To you or those involved in your care

  • With your authorization

  • For national security, correctional, or law enforcement

  • As part of a limited data set

Requests must:

  • Be in writing

  • State a period (no longer than 6 years)

  • Specify form (paper or electronic)

The first list in a 12-month period is free. Additional lists may incur charges.

For electronic health records, you can request a 3-year accounting of disclosures starting from the date the EHR was acquired.

6. Right to Receive a Copy of This Notice

You may request a print or electronic copy of this notice at any time.

How We Collect Information

At Encinitas Dental Art, we collect:

  • Personal Information: Name, contact, insurance

  • Health Information: History, diagnosis, treatment, billing

  • Technology-Based Info: IPs, cookies, analytics

We collect this data through forms, interactions, third-party providers, and electronic communications.

Note: No mobile data will be shared with third parties for marketing. Text opt-in data will not be shared.


How We May Use and Disclose Health Information

HIPAA allows use/disclosure of health information without permission for:

Used to provide and manage your care.

2. Payment

Used to determine benefits, facilitate claims, and coordinate coverage.

3. Healthcare Operations

Used for quality review, training, accreditation, scheduling, etc.

4. Legal Requirements

Disclosures may be made when required by law, for public health, abuse, legal matters, law enforcement, national security, or Workers’ Compensation.

We strive to disclose only the minimum necessary information.

We will never sell/share your information for marketing without written consent.

We follow stricter state/federal laws if applicable.
